Legal Question in Family Law in Alabama
I was with this man for over a year, and we lived together for a year and filed joint income taxes. We are now separated and I am 36 weeks pregnant with his child. Do we have to get divorced? Also every time I text him something about his child he text me something vulgar about his new girl friend or he threatens to take my child when she's born, or says she isn't his. Also he goes to the local police station and files a report saying I'm harassing him, what should I do?

Stop texting him. Quite obviously it is over and he does not want to know anything about you or the child. Now as far as getting divorced, only if you claimed to be married on the income tax or held yourselves out publicly as husband and wife do you need to file a divorce. As far as the child, I would suggest you not try to put his name on the birth certificate as the father. Better practice would be to decide if you want to go to court for paternity and child support.
