That depends. Where were you married. Where do you live? Was your last divorce ever finalized? If you are in Alabama, and you were married to spouse #1 when you participated in a marriage ceremony to spouse #2, the marriage to spouse #2 was not valid when made. However, when the divorce to spouse #1 became final (and you were thus eligible to marry again) you then became married to spouse #2 by common law marriage (If you were in Alabama)
