Legal Question in Family Law in Alabama
I was married for 30 years. During this time My x husband had abused me and my children to the point that we had to leave our home once by court order so far away that if I came home with my children they could be removed because of my x husband abusing us. I left him a total of 6 times, the longest was for 6 months. It was VERY difficult because I had 3 small children and no where to live and applied for housing but there was a 2 year waiting list and we ended up back with him because I didn't want to be homeless with 3 little kids. Anyway, He was arrested in April of 02 for 2ed degree aggravated assault on me when he broke my hand and pushed me down in our garage and I hit my head and now knowing I cracked my teeth. He payed off the police,He payed off the lawyer he used so the lawyer used a judge who was having an affair and not divorced himself and ended up settling out of court with his x wife for 200,000.00. This judge is the one who ordered my x husband to pay me 50.00 a month and me disabled! with zero income! I had to find ways to support myself for 2 years waiting for my disability to start. I cleaned homes when I could,stayed with my son a few months,that was strained,my x had choked him with his hands and we both were upset. Then I found out he had an affair with supposed to be a friend of mine. I got one check for 50.00 from her checking account on the 1st month and then on the 2ed month with her name and his on the check and the 3erd month the same. On the 4th month I wrote on the memo the check was for My x's name- 2ed degree aggravated assult on April 18,2002. I know that propably was not the thing to do but I lost it with all that happened. He has not payed in 5 years. Does he have the right to decide to pay or not? By the way, his attorney has been disbared and the judge had to retire. His attorney was charged with stealing someones insurance money and the judge had to eather retire early or be removed for his actions and no one would vote for him again. I had an attorney from a shelter and the judge didnt like that eather,she was a woman. What can I do?
