Legal Question in Family Law in Alabama

Moving Child Outside of the State

Can my ex-wife of six years legally move my daughter outside of the state of Alabama? I believe she has plans to move to South Carolina. She has moved there once before and returned to Alabama. I didn't like it then and if possible would like to stop her from taking my daughter this time. She has full custody, but I do have weekend and holiday visitation rights. What are my options?

Re: Moving Child Outside of the State

you should check your divorce decree to determine whether or not the court addressed removal of the child from the state of alabama. your possibl remedy is to file a petition to modify the terms of the divorce decree if the removal issue is not addressed in the decree. the court will be looking to the best interests of the child in determining the issue.
