nonparent guardianship of minor child

My ex husband has legal custody of my 15 year old ''former'' stepdaughter and wishes to give legal guardianship to me. She lives with her mother and that situation is no longer in the best interest of the minor child. Her father is incapable of caring for her at this time. She lived in my home prior to our divorce. My question is- how do we go about establishing guardianship? What legal documents are necessary and do they need to filed in the courts?

The best way to go about this is to file a joint petition by all three adults in Juvenile Court requesting this change. You will need a lawyer to do it and the Judge will have to be convinced that the move is in the child's best interest. It doesn't sound like you would have any trouble getting this done. This would be a temporary move and would be subject to some monitoring by the court. Any competent attorney should be able to handle it for you.
