Legal Question in Family Law in Alabama

Personal Accounts

I am getting divorced. I make a lot more money than my husband. I have a personal account that I deposit my work bonuses and other financial perks from my job. Will I be required to share that money with my husband in the divorce? All of the money in this account has been earned from me and taken from my paycheck. None of this money is from him. Will he have access to expose this account and benefit from this money?

Re: Personal Accounts

These are questions you really should ask your lawyer if you have one. If you do not have a lawyer, you are going to need one or you will be lost in the maze and unable to get your 2 cents worth in if your spouse has a lawyer. You will be at an unfair advantage. But a lot of what you ask depends on the both of your income and the aggressiveness which he takes. If you do not have an attorney, I will be happy to talk with you if you will call me. Re: Personal Accounts

Since the money in the account was accumulated during the marriage, it is part of the marital estate. In Alabama, the trial judge has wide discretion to make an equitable, not necessarily equal, division of the marital estate in a divorce. The money in the account is one of the assets that will be considered. You need an attorney if you don't already have one.
