Legal Question in Family Law in Alabama

Pregnant and going through divorce

My soon-to-be ex and I have been separated and in different states for a year and a half. We have two children that he is not able to see now due to a protective order that expires in May 09. I have filed for divorce but things are going slowly because of the protective order. Meanwhile, I have become pregnant by my furture husband. We are older and do not want to terminate the pregnancy, but of course, I do not want to make my divorce any messier than it already is. How will my being pregnant affect divorce proceedings?

Re: Pregnant and going through divorce

It means the husband is the legal father of the child because a child born to a married woman results in the husband being the legal father under Alabama law. Do not terminate the pregnancy. Go forward. Tell your lawyer and work with it, especially since you and your husband are in different states. Do what it takes to get a settlement.
