Question about a getting a divorce
I wish to get a divorce from my husband who I have been married to since Nov. 26 1993, and I have been seperated from him since 1997. I have a child born with another man and the judge I spoke to said he cannot grant me a divorce until the paternity test is done. I don't have to the money for a paternity test and he will not help pay for it or the divorce. I really want to be divorced from him but I cannot get enough money for the paternity test. what are my options?

I do not see where it is necessary to determine paternity of this child before getting your divorce. Perhaps it is because there is a presumption of paternity if you are married. In any event, you can go to your local Dept. of Human Resources and they will open you a case for the paternity. They will handle the whole thing as long as you give them the name of the father. It will not cost you any money.You can then contact Legal Services Corp. to see if you qualify for a free divorce. Also, you can call the Ala. State Bar which is listed in the yellow pages. We have a pro bono program where lawyers agree to do cases for free. If you qualify, the bar will refer you to a lawyer in your area who will represent you for free.
