Legal Question in Family Law in Alabama

Does remarriage change child support rate?

Seven years ago, my girlfriend got pregnant and refused a DNA test. After running off for 6 years she came back and wanted one which proved positive. She doesn't have custody of the child, her mother does. But the court ordered me to pay child support. When I asked for a court appointed lawyer they told me I would need to be facing jail time to receive one. My current girlfriend wants to get married but makes almost twice as much money as I do. Unfortunately she's also $50,000 or so in debt so uses all her money catching up. I bring home about $1,000 a month after taxes, and have one other child that I have custody of. My question is if I remarry, will they take her salary into effect on my child support? Best I can figure it would be around $539 a month, and I can't afford that when I only bring home $1,000 a month. And still have to pay for daycare, half the bills, ect. I also have no visitation with this child by my choice, due to the fact after 6 years I only saw the child one time for the DNA test.

Re: Does remarriage change child support rate?

child support is based on your income in combination with the income of the mother of the child. the income of your new wife should not be a factor. there are other factors to be considered in determining child support so you should consult an attorney in order to obtain an accurate child support figure.
