Legal Question in Family Law in Alabama
I am currently residing in SOUTH AFRICA and shall be pleased if you would kinldy assist me with my query.
I have 2 children from my ex-girlfriend, the oldest being 3 years and the youngest 5 months.
During the duration of our relationship, she has never taken care of the financial needs of our children as has also been involved with drug abouse prior to our relationship.
There is never enough food in their home and on numerous occassions have given her money for same. She is still unemployed yet she is still making huge debt from dangerous people, which i have to pay as i do not want to endanger my childrens lives.
I would like to apply for full custody for both children and would like to know how do i go about it please.

Wow! Yours is a difficult situation. I assume because you posted here that the woman is currently living in Alabama with the children. If that is the case, then Alabama has jurisdiction over this matter and you will have to bring an action in Alabama court. Don't think that prejudices your case, though. We have several out-of-state clients engaged in custody battles with locals and in my experience they always get fair treatment.
You are going to have to file a petition to establish paternity (if that has not yet been done) and determine custody. You will at some point have to come back here to appear in court, so be prepared for that. Look to spend at least $3000 in attorney's fees as well. As I said, its a difficult situation. Best of luck.
