Legal Question in Family Law in Alabama

Separation or divorce: Who's responsible?

My husband left me and our 7 month old. He is not completely sure he is gone for good, so he has not made any legal move. I have thought of filing for a separation. Should I wait for him to do that. When child custody is considered later on, will it be held against me that I filed for the divorce? And, in cases of abandonement, is custody awarded to the parent who was left or is it shared? I do not want him to have the right to come and go when he wants. I want to make sure i have control of that. Should I continue with the separation papers or wait for him to do that?

Re: Separation or divorce: Who's responsible?

Well you have several questions here. Who filed doesn't affect the amount of child support, that is set by statute. As to the other questions, I would need more information.

Please contact my office by phone or email so we can talk. The initial consultation is free of charge.

Thanks!
