Legal Question in Family Law in Alabama

separation

I have been separated since sept. 2005. we were back 2gether after a recent split in 2003 when he -my husband rented a house in his name. He thought I was going back out again and put all my clothes outside. I moved out got my own apartment and had to move in with my mom cuz I couldn't afford my bills. We have a 16 year old son who stays sith him cuz he goes to school in the town he lives in. I continued to pay for sons braces and although I made more than my husband - I had more bills and I work In the town they live in and gas is quite expensive. I want to go home. I had a midlife crisis and found I had several health problems- had sleep apnea,etc and was sleep deprived- worked nites- I just was overworked and stressed. I have tried to get counseling to deal with everything. Losing my whole family at once. I want to go home. He has not divorced me- cuz he said he dont have the money. Can I move back in his house with my son - Legally? Please help! Remember rental house is in his name

You say you were separated in September 2005. Was this a legal separation (i.e., did it go through court and a judge signed off on it), or was it just a mutual promise between you and your husband? If it was the former, then the terms of the decree would apply. If it was the latter, then the situation may be different. It does not sound, however, like your husband has invited you back. You may want to consider safety issues.
