Children cannot decide they want to leave home until they are 19 years old or otherwise emancipated. Their father is the person who has custody of them (I understand mother is dead). Absent an accusation of abuse or neglect the state will not get into this. The father and grandparents could jointly petition the court to award custody to the grandparents. Father is going to have to then pay child support. Good luck
