Legal Question in Family Law in Alabama

I am an unmarried mother of two, 2yr old and 6months, who wants to leave their father and move to another state. I want equal custody and visitation between both of us for the kids. He signed an affidavit of paternity and I need to know if I can take the kids with me to the other state and what both of our rights as parents are to the children please.

You must go to court under a Child SUpport action. There you will ask the court to establish paternity in the name of the father. You will ask the court to give you primary physical custody and order him to pay child support. You will be required to cooperate with reasonable and liberal visitation for the children. You have to go to court in a lawsuit to do this. You can't just do it with an affidavit of paternity alone. Paternity must be adjudicated in court. Good Luck
