Legal Question in Family Law in Alabama

Unwed mother leaving Louisiana with infant

I have a six month old child and was living in Louisiana. The father of my child stopped helping me months before, I ran out of the money I had in saving and could not aford to live in my apartment anymore and I had no family in Louisiana so I came to Alabama to my parents house to live. He was not around all that much when I lived in Louisiana especially into October and November. I had no other way to live, I left my job of 2 years to come home. I have been gone since the week before Thanksgiving. The father has known that I have been gone and has not contested my decision at all. He has a major drinking problem...he got a DUI in May...he is driving without a liscense...he owes back childsupport of almost $15000 for another child. He is now threatning to take me to court. Does he have the rights to fight me for any amount of custody? Was it leagal for me to leave Louisiana even though he knew?

If there is no custody judgment, then you can go where you want. I suggest you file to be named sole custodian of the child and to set child support. Do it in Alabama and let him come forward and object.
