Legal Question in Family Law in Alabama
visitation and abandonment
divorce was filed in Dec 05, put admin docket in Oct 06 to attempt reconcilliation. Did not work. I want to go to UK to find work and have support. Will pay child support and half morgage, however can he say I have abandoned if I manage to push divorce through using lawyer in UK. He is holding things up this end and I think blocking me from getting a job so I am backed into a corner. Need to leave to sort out life but child wants to stay here. I will still want visitation and do not want to lose half house which has been already agreed upon Where do I stand.

Re: visitation and abandonment
I do not see any way you can use a lawyer in the UK. You will need some attorney here in order to represent your interest here. It would not be abandonment as I surmise you are separated and have been separated. As long as you maintain support, communication and visitation with your child. You have property interest that will need to be divided by the court. I can not say that paying 1/2 of the mortgage would be the best settlement. A more reasonable settlement would be for one person to get the house and refinance the house in their name and either you get 1/2 the equity or some other type of settlement.
