Legal Question in Family Law in Alabama

My wife has been placed in jail for five days because she broke a court order from judge Michelle Hart.This is understandable , what i can't understand is how they can give custody to a man who is not on the birth certificate,never married to the mother and never taken a D.N.A. test. he also has two counts of domestic violence. The mother Jamie L Stewart maiden name wright has no criminal history other than a couple traffic tickets. The presumed father is Tony Graham Burt the adopted son of Baldwin county Commissioner Frank Burt. How did they get visitation let alone custody?

If they both admit he is the father, then that makes him the putative father. Now I do not know if you know all that went on in the court but I would advise you to consult her lawyer. If she did not have one, then the court should have appointed her one if she was indigent.
