worried about adoption!

my question is my mom got temp custody of my son in June of 2007. She has money and I do not. I have been allowed to see him once in seven months, but talk to him almost daily. I am trying to get another attorney appointed, because I cant afford to hire one. My mother says she is going to adopt my son, and says she can do so because she is wealthy, and I am not, and says I dont have a leg to stand on. I am trying hard to get my son back, can she just adopt him without my conscent, or because I am in a hard time financially? Please tell me what recourse I have to fight that if it is true, and what steps she would have to take to be able to just do that to me!!!! Thank You so much...

For an adoption to take place, your mother would have to either have you agree to the adoption or seek permanent custody. If only temporary custody was granted, there is still a possibility of you regaining custody if you petition the court and show that your situation has changed for the better and that it would be in the best interest of your child for you to have custody. The main thing the Court will look at is what the child's best interest is. Money is not a factor in whether custody or an adoption is granted.
