Does a case have to be tried and over with before the statue of limitations run out?

No. The time limitations on actionable claims applies to "filing it" as opposed to "reaching a verdict/settlement."
For example, if you suffered injuries from a negligent driver in a automobile collision on October 1, 2012, Alabama allows you two (2) years from the date you suffered your injuries/damages to file suit against the negligent party. Therefore, you bear no risk of losing your right to sue as long as you file your claim in the correct court by October 1, 2014.
