Legal Question in Civil Litigation in Alabama

Dog Impregnating Dog in heat

My dog escaped from my fence and went approximately 1/2 mile away where there was a dog(s) in heat. The owner just called me and told me that the dog is pregnant and she thinks the other one is also. She wants me to pay to have the fence that he busted through fixed and also for the abortions and spaying that will need to be done. What is my liability here? I took extra care to contain my dog and she left her dogs in her fenced in back yard knowing they were in heat. Her neighbor saw my dog actually mating with one of the dogs.

Re: Dog Impregnating Dog in heat

If you are determined to be negligent in the containment of your dog, you may be found liable to your neighbor. The test to determine negligence is what a reasonable person would have done in like or similar circumstances with regard to the actions you took to contain your dog. If it is found that your neighbor was contributorily negligent, then he/she would be barred from any recovery against you, even if you were deteremined to be negligent.
