Legal Question in Civil Litigation in Alabama
Noisy Dogs
I have a very serious problem. In my neighborhood ther are 3 neighbors with alot of dogs (one has 2, the second one has 2, and the third has 3). The problem is that these dogs constantly bark, especially at night.
Last year, when it started, I went to City Hall 3 or 4 times to complain to the City Administrater (our mayor is only part-time and does not work days). All I got for my efforts was one trip made by the city's "Code Enforcement Officer" in the middle of the day. He stops at the corner, rolls down his window, hears nothing, and drives off.
Two months ago I called the City police. They said OK. I do not know if they ever came out.
Two weeks ago I again called the police and they told me that "it would be a while". Last week I again called the police and they again said "it will be awhile". This time they gave me the telephone number of the Code Enforcement Officer (see above). I called the number and no one answered.
What can I do ? The city does have a Nusance Ordinance which covers noisy dogs, but the city will not enforce it.
Please advise.

Re: Noisy Dogs
if the city has an ordinance regarding barking dogs and if your facts fit the requirements of the ordinance, you should contact the city magistrate regarding the possibility of issueing a warrant or citation to the offending dogs owners. if the city does not have such an ordinance then your only recourse may be a civil action which would be difficult and costly
