Legal Question in Civil Litigation in Alabama
I have on ongoing unlawful detainer case. The judge held off on the judgement until we could get the house back and determine the damages. The judge said we could submit the damages by affidavit which we did, and he denied it. He gave us time to file an alias amenede complaint. I would like to continue the case as filed without doing the amendment. What document or request would I need to file in order to have this done. Also, is there a time limit on filing the amendment? If I understand what you are saying, you are asking how to continue the case. That would be a simple continuance. The Judge apparently didn't believe what was in your affidavit. You would ask the court to set this matter for a hearing after you have amended your complaint. You will have to move the court to expand time to amend the complaint. This is complicated, you should seek legal help here.
