Legal Question in Civil Litigation in Alabama
Put truck in "Daddy Can fix It" repair shop for rplcment of
head gasket; apprx 3wks later, tld by owner trck was
repaired. Paid ($600 + $500 for parts) but had 2 brng
truck right back as was not actually repaired (leaking oil
now, was not b4 and running rough). Aftr apprx 3
months passed, had to call weekly trying 2 encourage
repair but was continually put off and tld they were trying
but were too busy until 1/07.11 when the shop called and
said I needed 2 pick up my trck because they were being
evicted from the property. Not knwing wht else 2 do,
went 2 shop 2 pick up trck; all power was off in building
(no lights) & parts were missing off trck (cat converter,
gas, battery, gas cap, idler arm pulley, ???). Upset, wlkd
2 back of truck 2 push truck out of garage (pitch black, no
inclination) & fell into a mechanics pit (apprx 6 ft deep, 3 ft
wide and 6 ft long); broke 3 ribs, out of work and sore 4,
2 weeks so far. Please help, I have been robbed, takn
advantage of & injured! do I have any legal recourse?

Unfortunately, the owner probably did not have any liability insurance on the property and can not pay anything as an individual as well. As far as the missing parts, the value versus the cost to recover would probably be prohibitive and the guy again probably has nothing and all you would get would be a judgment.
