Seizure of my boat

I had a month-to-month lease to store my boat. The storage company was bought by a new company. My lease said I had to give 30 days written notice to get my boat out, but the lease was not transferrable. I gave 30 days to old owner but cannot prove. I asked the new owner to do repairs to my boat right when he bought it but told them I was taking it out of storage. When he got it down, it was seriously damaged and he refused to fix. I asked for return of my boat. He will not return it because he says my old lease automatically rolled over to his new lease and I never paid my final bill to the old owner. After 5 months, he agreed I did pay my bill as I said, but now wants me to pay the 5 months he kept the boat against my will. I want him to pay the damages and forgive the 5 months since I asked for my boat, never signed his new lease, and had no lease with him. He refuses and won't go to Bettter Business Bureau mediation. The boat is worth about 7000 but the damage is about 2000 and back fees are 500. Can I sue in small claims court to get my boat back? Can I win this? Can I get punitive damages?

depending on the facts surrounding the damage to your boat you may have a good case to recover for that damage. i would need to know more facts regarding the keeping of your boat and how many times you demanded return of the boat and how demand was made.
