Legal Question in Health Care Law in Alabama
Obtaining Death Records
I want to know why I am being denied a copy of my ''deceased'' mother's medical records at the Cullman Alamaba Regional Medical Center. I am immediate family and am her daughter and I want to know everything that happened to her.
I am stated as second executor on mom's and dad's will in the event first executor dies. I am on her and my father's banking account and others accounts.
I feel that the hospital made a major mistake which contributed to her death this past December 16, 2005. How can I get her records.

Re: Obtaining Death Records
you must open your mother's estate and present the hospital with Letters Testamentary. The Probate Judge will give you several certified copies to use for things like this. You can either have the person named as Executor open the estate or if they don't want to, have them sign a wavier and do it yourself as secondary executrix. You will need the services of an attorney to open this estate. If you think medical malpractice was committed in your mother's treatment, I would be willing to look at this matter for you. I am in Hamilton which is about an hour from Cullman. You can visit my web site at http://fredwoodlaw.lawoffice.com. Best of luck.
