Legal Question in Insurance Law in Alabama

Automobile accident - other driver at fault and she has no insurance and no job

We live in Alabama, where as of a couple of years ago, a mandatory liability insurance policy was passed. The lady pulled out of a service station, across several lanes, right in front of my husband. She never even looked, had the audacity to ask ''where did you come from?''. We have the police report . They said we could file an SR13, but all that does is pull her liscense. If we do that, she'll probably use that as an excuse not to find a job. IF she does start working, they'll just garnish her wages. Until then, my husband's car is not even driveable. Now he is stuck having to shell out more money on another car, when the one he had was perfectly fine and paid for. Is there anything we could do? Is it pretty much hopeless, or is there more we can do?

Do you have uninsured/underinsured coverage in your policy? If so, you may be able to make a claim with your policy. If not, you may need to sue the other driver for damages. If she can't pay, you'll be stuck with a judgment against her and can file a lien to ensure that if she gets a job or if she sells property, for example, you can get paid. You should contact an attorney if you are unsure how to proceed.
