Legal Question in Insurance Law in Alabama
Automobile accident
I was hit by a car and the driver admitted fault on the official police report. Their insurance had also expired (reqired by state of Alabama). I only had liability on my truck. The estimated damages to my vehicle are more than the book value. Since there are no insurance companies involved, if I took this to small claims court, what procedures would a judge use to determine the value of my truck ? I assume as just with an insurance company, this individual would not be required to pay more than the value.

Actually I would recommend another course first. Have an attorney file for your uninsured motorist coverage on your policy. All policies have this. He could likely recover enough to let you buy another car and maybe have some left over. Court should be your last resort.
