Legal Question in Insurance Law in Alabama
I divorced my childrens father in 1999. In our divorce decree it states, he is to keep all life insurance he has inrevocably in our childrens name. He passed away April 15, 2009. His insurance policy gave my children each 30% and his exwife 40%. His wife of only two weeks (which he had already seperated from) is disputing this saying she should get the 40%.
Who should legally get the forty percent?
children
exwife
new wife
Thank you,
Lila Smith

Unfortunately, unless he changed the life insurance policy, the ex wife gets it. Life insurance is a contract and is not affected by divorce.
