Legal Question in Insurance Law in Alabama

Health Insurance Appeal Denial

During the last month of my pregnancy I was diagnosed with preeclampsia. After my daughter was born I was still very ill. My doctor felt that I was not well enough to be released after the usual 48 hour time limit and had me stay an extra day in the hospital. My husband and I received a bill from the hospital for the extra day ($1500.) We filed an appeal with BC/BS which included a letter from my doctor in which she explained my condition and stated that the extra time was ''absolutley medically indicated.'' Our appeal has since been denied. I know that the Mothers' & Newborns' Act of 1996 allows for a minimum of 48 hours for a normal vaginal birth. Is there anything else we can do, or should we just pay the bill? Thank you so much for any thoughts or advice.

These types of cases are very difficult to win, but not impossible. There is an attorney here in Birmingham who does a lot of them. Contact my office and I will give you his name and number.

Thank you very much.
