Drug Testing

Is it legal for a temporary employment company to take out a $25 drug test fee without actually initiating the test?

Actually there are no real laws particularly dealing with this issue per se. It could however be fraud and breach of contract. What it really could be though is a violation of the Federal Fair Labor Standards Act if in fact the fee brings your wages down below minimum wage. If you are only making minimum wage than any unauthorized deduction is a violation of that act. If they are doing this en masse to a large group of employees this would make a darn good class action.
