severance pay / earned pay

Upon employment termination:

Is an employer obligated to pay either in lump sum?

Can employer choose to defer payment of either in weekly, bi-weekly or monthly payments?

Pay what? Wages or some other payment? There is little law on the issue of severance pay unless it is part of a bona fide employee benefits program.

With respect to hourly wages, they must be paid when due. If not paid when due then send a demand letter and if they still don't pay you can nail them for failing to pay wages. However you only get $10.31/hour (twice minimum wage). If you are an hourly paid employee and they are not paying you your wages and they have over 20 employees and you live somewhere in Northern Alabama let me know, and I would be happy to hammer them for you.
