Down sizing

My husband's company is considering doing away with his department and laying off all the workers. To take their place they are bringing in an outside company to do the same job. He has been with this company 21 years. Can they do this and is this legal? Thank you,--name removed--Kerr

In a nutshell, yes. However, there may be some severe restrictions depending on the size of the company and the size of the layoff. If it is over 100 people, or 1/3 of a larger company, they will have to give your husband 60 days notice of the plant closing or else pay 60 days severance pay.

There may also be problems if the department in question is predominantly African American or Female, such that discrimination can be inferred.
