Legal Question in Personal Injury in Alabama

Air bag deployed injury...no accident involved.

On Monday I was entering my friends vehicle and while putting on my seat belt the right passenger side air bag deployed from the seat. Hitting me in the side and back. I am 15 weeks pregnant and have swelling and a large chest wall contusion on my side. It is a side airbag. We were not moving and the car was not started when the bag exploded into my side. I am continuing to experience back pain and headaches. They sonogram showed that the baby is moving and seems to be uninjured but the Ob Gyn is going to continue to monitor the situation. What responsibility does the car manufacturer have to me regarding medical bills and compensation of settlement for further medical treatment?

Well, first let me say that I hope everything is okay with your baby. My wife and I have been through scares with pregnancy before and I know what that's like.

Assuming some inherent malfunction (as opposed to maybe some alteration or modification made by the car's owner) caused the air bag to deploy, certainly the manufacturer is responsible for your medical bills, pain and suffering, lost wages, etc. that you may incur as a result of this injury. I would speak with an attorney about this case so that he or she can provide more detailed advice. Most attorneys will take a case like this on contingency, meaning you won't have to pay anything up front for the legal fees-they can just take their fee out of any award you get through court or settlement.
