Auto Accident Personal Injury limits in Alabama

Good Morning,

I am trying to get information on personal injury limit amounts when filing a case for my son who is a victim of an accident. We were told the state only allows 40,000 dollars and it must be split with any parties that file a suit against the insurance co. or person causing the accident. can you please help with this?

Alabama does not limit the amount you can recover. The recovery amount is limited based on the wrongdoers policy limits (or the injured party's "uninsured/underinsured limits if the wrongdoer doesn't have insurance). Alabama has a minimum amount of insurance required to be carried by anyone who has liability insurance (which is probably what you were told about); however a person can always carry more insurance. You should definitely contact an attorney because there may be other insurance available to you or other ways to get more money depending on the specific facts of your case, and the insurance company will NOT volunteer this information to you.
