Dog Attack

My daughter and her boyfriend were looking for a lost pet on private property. There was a Beware of Dog sign at the gate. they walked up the driveway to ask the owner if she had seen their pet. They were attacked by her German Shepherd. The boyfriend was taken by ambulance to the hospital, and required 23 stitches. My daughter is traumatized. Is the property owner civilly liable for the attack by her dog?

Potentially. It depends on all of the facts, i.e.: did the owner of the home tell them to get off of the property, or did the owner invite them to the door? Were they prevented from approaching the home? Did they see the sign? Where was it posted? What is the history of the German Shepherd? Where did it attack him? Was the dog behind a fence? Did the owner do anything to prevent the attack? How did he get away from the dog? These are all questions which need to be pursued in order to determine if there is any liability on the dog owner. Another question is whether the owner had homeowner's insurance and whether the policy excluded this type of dog, or dog attacks in general, from coverage.
