Injury to Child at School

My son, 11 years old, was at school and left unattended on the gym bleachers during P.E. Another child pushed him from behind and he fell down and broke his ankle. To what degree is the school system liable for his injury? The school refused to accept responsibility for it and would not give the name of the child or his parents to pay for the medical bills. Can a public entity such as the public school system be sued?

Well, yes and no. It's kind of complicated but generally you can sue a government entity under certain circumstances. It sounds like you might actually have two claims, one against the school and the other against the parents of the other child. Without knowing the exact situation and the details (i.e. how many kids and how many teachers/adults were present, witnesses, condition of the bleachers, etc.), it is impossible to give a completely thorough assesment. I would suggest seeking an opinion from an attorney who can take down all the details and do the research to see exactly what your prospects are.
