My 14 yr old daughter was a passenger in a 3 car accident she was in the last car. She was knocked out cold by the airbag and then when coming to she was combative and they had to restrain her. The police and the Emt's forced her to the ground where she endured more injuries. She has loss the use of her left arm. (Brachial plexus avulsion) Her nerve roots have been torn from the spinal cord. This is the 2nd accident on school grounds this year. Cross walk used but no one manning it. Kids ran out into traffic causing the accident. Who do I hold accountable?

I would have to know additional information. First, the person/company who caused the accident; second, the emt's may be liable for her injuries; and third, anyone else who may have contributed to the injuries, i.e. did the school know this was a dangerous situation or did they follow standards for such situations?

You should really talk to a lawyer in person. No one should charge you anything to talk to them and, if the lawyer takes your case, you should sign a contingency contract and not have to pay anything out of pocket.

Both Jon and Randal have given you good advice. While I would need to know more information to provide you with a fully informed answer, in addition to looking into who to hold responsible, you may be able to make a claim on you daughter's behalf for Uninsured or Underinsured motorist benefits. If you have auto insurance and did not opt out of this coverage, you have been paying for it so you should take advantage of it. You may also be able to make a claim for UM/UIM on the driver's insurance.
