How much should I ask for?

I was recently involved in a car accident, where the other driver was at fault. The accident was 5 weeks ago and I am still very sore and bruised. I started with the e-r after the accident. No broken bones just bruised very badly on my torso and legs. I had x-rays performed again to make sure of no fractures. I then started having therapy because about 2 weeks after the wreck my neck began to ache and throb and shoot pains. I again went back to the doctor and he sent me to have an MRI performed. The result was I have a Herniated Disk in my neck from the whiplash. I saw a neurosurgeon yesterday. No surgery is required at this time but I could have to have surgery one day as a result of the herniated disk. My question is how much do these kind of settlements usually settle for

in or out of court. My Chiropracter told me in the neighborhood of 100 to 140 thousand. He said it was that high because I would always have the disk problem the rest of my life. He also told me that I could get this on my own without consulting legal council. Please any advice would be greatly appreciated. Thank you.

Only 2 groups of people can answer this question: the insurance company writing the check or twelve people on a jury after they have heard all of the evidence. A lot depends on what the doctors say regarding your injuries, their relationship to the accident, and the liklihood that future surgery will be necessary. Other factors include your age, education, work history, current employment, lost time from work, health insurance payments, extent of the damage to the vehicle, whether or not you have uninsured motorist coverage, total medical expenses, what jurisdiction you are in, etc. All of these factors must be considered before a valuation can be made, and even at that point, it would be an educated guess. I have had cases involving herniated disks which have ranged from $5,000.00 to over $100,000.00.
