Legal Question in Personal Injury in Alabama

If the registered owner of a car with known brake problems allows another person with knowledge of these problems to drive the car and this other person cannot stop the vehicle and kills someone, can the registered owner still be held liable both civilly and criminally in Alabama?

From a criminal aspect probably not. However, if the owner carelssly, recklessly and/or knowingly placed a dangerous vehicle into the hands of another to operate, the owner may have some civil liability exposure. If the owner had insurance and the operator was a permissive user then the owner's auto-policy may also come into play as primary coverage.
