Slandered?

A person on the internet and I (we both knew each other) got into an argument because she had been bashing me behind my back for no reason. I sent her a not so nice email and she replied. This kept up. It was very immature and stupid. Then she got one of her gal pals onboard and that friend posted on her web blog for all to see that I was a homosexual, a bold faced lie. She never used my name in the entry but she gave the details so everyone would know that it was me she was talking about. Does this count as slander or libel? Thanks for your help.

Yes it is slander or libel, as long as it is untrue. Furthermore, a sexual allegation of this nature probably does not require proof of specific damages such as loss of your job, whereas other types of libel and slander might.

However, that doesn't mean you have a lawsuit automatically. You can sue this girl and maybe even obtain a judgment. But will you collect? Doubtful. And most attorneys don't take these types of cases unless the statement was made by a corporate officer as part of his official duties. If IBM were to come out with a press release, or if the Birmingham News were to run an article about your homosexuality that would interest an attorney. But some stupid bitch on an internet chat board? Most attorneys I know of would say get over it - or alternatively file a district Court claim and handle it yourself.
