Son Murdered

My son was killed on Jan.25,2003. He was hit by a car. There was no accident report filed only an incident report. I need to know what actions I can take to file a wrongful death case. Also, the investigator at the scene has not done his job what can I do about him? There was no statements taken from but, one person and that person was not an eyewitness. The person that hit him has a lot of influnce where I live and the State Troppers office has tried to cover this up. What can I do about this? Thank You for your time.

What needs to be done depends on more information. Do you think this was a murder, meaning someone intended to kill your son, or do you think it was an accident - a hit and run. Strategies depend on the facts. Could you tell us a bit more?

What you are probably looking at, assuming that you son was in no way responsible for his death, is an action against the driver of the automobile that struck him. If the other driver has insurance you may be able to collect that in addition to any insurance coverage (auto) that your son may have had on a car, OR, if he was still "on" or "covered" by your policy, he may also have a claim on any uninsured/underinsured motorist coverage.

As the other lawyers have told you - YOUR ARE FACING SERIOUS DEADLINES IN FILING YOUR POTENTIAL CASE OR CLAIM. YOU MUST ACT IMMEDIATELY TO HAVE AN ESTATE ESTABLISHED (Probate Court Action) AND THE CASE FILED BEFORE THE STATUTE OF LIMITATIONS RUNS (which will forever bar you from seeking any compensation).

You need to talk to a lawyer on the telephone this week. I encourage you to NOT delay in seeking legal representation (regardless of who you choose to help you).
