subrogation against car rental co.
Can a car rental agency deny subrogation reimbursement to an insurance carrier if the carrier's nsured didn't file a medical claim against the car rental agency? Insurance company paid medical and now want to be reimbursed.

Yes. If the insured has a valid claim for personal injuries, then it is probably worth more than the paid medical and the insured should consider hiring a lawyer to pursue that claim.
