Legal Question in Personal Injury in Alabama
I was walking to my car at a fair and was struck by a car. The car was in a barricaded area. The fair personnel instructed the driver to back up because he wasnt supposed to be driving his car through this area. I was struck and knocked
to the ground. Luckily I wasn't injured. I was only frightened because it could have killed me. Do I have a negligence claim? Can I sue based on this? The police wrote a private property report.
1 Answer from Attorneys
Yes you have a negligence claim;however, because you did not require any medical care the settlement offer from the at-fault driver would be nominal. Yes you could sue but you will probably have a hard time finding an attorney to handle this on a contingency basis.
We usually advise potential injury victims to handle smaller claims on their own. The more significant the injury and the more protracted the care and treatment, the more you would benefit from an attorney.
