Legal Question in Real Estate Law in Alabama
I was awarded a default judgement for the return of earnest money on a house. Because I listed the owner of the house as the defendent and not the Real Estate Company where the money is held in a trust, they will not release the money. I have been told that I need to file a motion. What do I do?

Because I have no more information that that above, it is nearly impossible to tell you what to do. If it has been 30 days since your default you can file a motion to alter amend or vacate and attempt to add the real estate company as a party. You really need to get a lawyer to do this for you. You have made one proceedural mistake, and need to act properly to protect your interest. Again, you should seek legal advice if you are serious about getting your money back.
