Legal Question in Real Estate Law in Alabama

My girlfriend's brother has a piece of property that runs in front of her house. They are not able to get water through that area, because he will not allow them to use the property. It would cost over 5000 dollars to put a new line it. Is it legal to deny their basic utilities because he owns the property?
