heir 's property

a house was built on property belonging to 9 heirs in 1989. at the time of the construction,a deed was given to us by my husband's father and uncle. at that time, they thought that the land was theirs but their deed was never recorded in the courthouse.the finance company charged us a title search fee. we are now in court trying to get this settled because the heirs would not sign a quick-claim deed. shouldn't the finance company be responsible as well?

In the title search that the finance company charged for, did you also purchase owner's title insurance (This is separate insurance from Lender's title insurance, which you were likely required to provide your lender)? If so, then you may have a claim against your title insurance. Your attorney in your court case can advise you further on how to proceed. Good luck!
