Legal Question in Real Estate Law in Alabama

Joint Property

In divorce decree it states we own joint property. Neither party will dispose of his or her interest in said property without the written consent of the other. For three years he and his girlfriend lived 25 feet behind my house in an RV. In 2003 he left while I was in Maine taking care of my ill mother. While I was gone he and 3 others destroyed, dismantled a two story barn, tack room with water and electricty and a 30' by 28' shop with electicity, water etc. Both buildings were worth about $18,000 a piece. He destroyed trees, fences, took my business equipment, etc. He signed a quit claim deed and later said he didn't. I had two witnesses sign along with him. After leaving - two months later I receive notice he has a civil suit against me for using the quit claim deed. I have been to 2 hearings, 3 lawyers, and still it's not settled. He will not let me buy his share and wants to come back to live on the property. Do I have any rights to force either one of us to sell. On this property (10 acres) we have on a different deed - my house, my child care center, my daughter has two acres, and my son lives in a mobile home. I have had the mobile home on the 10 acres from the beginning. Sounds confusing, well it is!

Re: Joint Property

Hmm, a couple of questions please. Why have you had 3 lawyers? Why was nothing resolved?

Have you countersued him for trespass and damaging the property?

Where are you now living and where is the property in question?

Thanks!
