Termite Problem

I purchased an exsisting home that is approx. eight years old. The home does not have a termite bond but it had an Alabama Wood Infestation Report done a week before closing.

I have a copy of this report and it shows the structure has no active termites and no previous termite damage.

After closing,approx. 11 days after the inspection for the WIR I found nine termite tunnels and active termites in the carport going up into the wall in the carport. My question is does this WIR make the pest control company legally responsible to re-treat the house and repair the damage.
