Legal Question in Wills and Trusts in Alabama
Help for my 16 yr old daughter
My ex husband died leaving one child. My 16 yr old daughter. he did not have a will. But he owned 3 homes and insurance policies. also have investments. I was told that I could not collect the investment money to put into her trust fund that I set up for her because I am not the excutor of his estate. NHone is over his estate. his family doesnt want anything to do with it. I was also told that if 2 years passed without being able to collect the investments that my daughter would lose it. I dont have the money for another attorney. Is there a way I can file to become excutor without alot of cost? There is alot at stake that my daughter may lose. It has been over a year since his passing. Time is running out quickly. Please, help me if you can! Thanks

I don't understand this comment "NHone is over his estate. his family doesnt want anything to do with it." Is this estate in Probate already? If not, you may certainly file to be named Administrator, assuming your ex-husband died in Alabama and was a resident here and assuming you do not have a felony conviction. Probate Court is not easy to navigate however; I suggest you find an attorney who will work with you, otherwise you stand to lose quite a lot. What is that saying, "penny wise and pound foolish"?
