Legal Question in Wills and Trusts in Alabama

My daughter is 6 years old and her father has always been in and our of her life, he doesn't pay child support and he doesn't see her on a regular basis. Since my daughter is in school, she ask questions about why mine and her last names are different. I even correct the teachers and other staff members when they refer to me as her last night. My daughter is young but wants to have the same last name as mommy does, I looked up having a minors name named, but what is the steps, do I have to have his signature and consent to do this? And what if I dont know where he lives, and I dont even have a number to contact him.........
